Imminent referral to the Normandy and PACA prefects to determine a new order of priority for consumer connection requests

Article 28 of law No. 2023-175 on renewable energy acceleration of 10 March 2023 gives regional prefects the power to modify the order of priority of applications for the connection of hydrogen production facilities, projects for the decarbonisation of existing facilities and projects that have been classified as projects of major national interest by decree. This Article is specified in Decree No. 2023-1417 of 29 December 2023 implementing Article 28 of the APER law and setting the conditions and limits for certain grid connection requests. 
 
Pursuant to these provisions, RTE must refer the matter to the prefect of the region concerned for a decision on a new order of priority of eligible connection requests when it is determined that, in a given area, the connection time for at least one of the projects mentioned above is longer than five years and that period is longer than the commissioning time specified by the applicant. 
 
RTE believes that the conditions for referral to the prefect are met both in the electricity zones around Le Havre and those in the PACA region (excluding Vaucluse). 

 
As a result, RTE will imminently refer to the prefect, who will then have four months to determine a new order of priority. RTE will transmit all the information at its disposal relating to the connection requests received (requested TFP and signed TFP) in each of these areas, regardless of whether they fall within the scope of Article 28 of the APER law. 
 
Connection requests received after referral to the prefect, as well as requests at the feasibility assessment stage, will not be eligible for reclassification. Please send your connection request within 15 days if you wish to benefit from the scheme. 
 
From that date, the processing times for connection requests will be suspended. This suspension will end on the day on which RTE receives notification of the regional prefect's decision, or, in the absence of an express decision, within four months of the date of referral to the prefect. TFPs received after this referral will not be submitted until the decision of the prefect.
